1.Purpose of this site:
This website aims to offer for sale for private art lovers, original photographic artworks whose the artist is entirely the author. These artworks are published in less than 30 copies.


2. Characteristics
These general conditions of sale are applicable to any order of artworks sold by the artist on his website. They can be consulted on the website and are considered accepted by the buyer before any order is placed.
These terms and conditions are subject to French law.
The French language shall prevail over any other language of translation used.
Links on this page to other third party websites are provided for information purposes only. The artist cannot be held responsible for any redirections, unavailability of these pages and related content.


3. Ordering
The buyer has the possibility to place an online order for a artwork using the link «Add to cart» present on each artwork description.
This action redirects the buyer to a Paypal payment page. This offers an immediate payment which, once made, validates the order and is worth acceptance of the price and descriptions of the ordered artwork.
This payment includes the price of the artwork and the delivery costs.


3.1 Purchase with a Paypal accoun
If the buyer makes his purchase with his Paypal account, the amount of the sale will be kept at least by Paypal until receipt of the artwork at the delivery address indicated at the time of the order, plus 1 day.
The deadline may be extended to 21 days. Consult the Paypal Terms of Use and its developments for more information.

3.2 Purchase without a Paypal account
However, it is not necessary for the buyer to have a Paypal account to make a purchase. In this case, the amount of the transaction will be available immediately for the artist, and the "purchase protection for buyers" offered by Paypal will be inactive. For more details, consult the Paypal Terms of Use.

Whatever the terms of payment and in case of withdrawal or claim, it is preferable to contact the artist who is committed to a fast and efficient processing of all possible requests (See articles: 7. Delay of withdrawal and 16. Claims).

4. Shipping
Once the payment has been made, the artist will be informed by the Paypal alert system that an order has been placed.
A shipping tracking number will be communicated to the buyer by an email from Paypal when the artwork is deposited at the carrier (Colissimo - La Poste).
The artist may also keep the buyer informed via email, as a matter of convenience and without obligation, of the receipt of the order and the smooth running of the shipment.
It is possible that the artist asks the buyer to validate the receipt of the artwork, once it is effective, in the "activity" dashboard of the buyer’s Paypal account.


5. Delivery address
The delivery address will be that indicated to Paypal by the buyer during the payment operation.
Additional annotations are possible before validation of the order on the Paypal form.
The buyer can also, if necessary, complete this delivery address by email to the artist via the Contact form available on the website. This information must be communicated to the artist via the «Contact» link, before the artwork is deposited with the carrier (Usually 1 to 2 artworking days).


6. Shipping Times and Transport Insurance
The shipping times run from the date of the deposit of the artwork with the carrier. This deposit will be confirmed, usually on the day of the deposit, by an email sent by Paypal to the buyer. The artist will also be able to confirm by email, on a user-friendly and non-binding basis, the deposit of the artwork with the carrier.
Since the delivery is handled by a transport service provider (Colissimo - La Poste), the artist cannot guarantee an exact delivery time. However, for deliveries in mainland France, the usual deadline is two (2) working days, and the maximum is usually ten (10) working days. After this period of ten (10) days, the buyer may ask the artist to intervene with the carrier to resolve a possible problem.

For deliveries to International, the delivery time is usually less than ten (10) working days.

The shipments are included with an insurance purchased from the carrier (Colissimo Ad Valorem) and the payment of the buyer will be fully refunded in case of not delivery by the carrier, after confirmation of the latter that the parcel is definitively lost.


7. Withdrawal period
In accordance with Article L. 221-18 of the French Consumer Code, a withdrawal period of fourteen (14) days is provided for orders and deliveries placed in France from the day of receipt of the order by the buyer. This receipt must be confirmed by the carrier (Colissimo - La Poste), after signature of the postal delivery slip by the buyer at the reception of the artwork.
To exercise his right of withdrawal, the buyer must use the form available at the end of this page.
This form must be sent to the artist, either by registered mail with acknowledgement of receipt at the address indicated in article "16. In the event of the return of the purchase, in the event that the request for withdrawal occurs after the handing over of the artwork to the transport company, the artwork must be returned to the artist as a whole, in the same state as at the time of receipt and in its original packaging, in Colissimo recommended or similar service at the following address:

Any return of artwork must be the subject of a formal agreement between the artist and the buyer.
The forwarding fee will be borne by the buyer in the case of return for exchange or refund.
Reimbursement shall be made within fourteen (14) days of receipt of the artwork by the artist.


8. Unavailability and Reserve
In case of possible unavailability of the ordered artwork, the buyer will be informed by the artist via email. The cancellation of the order for the artwork and its refund will then be made.
In some cases, such as default of payment, incorrect address or other problem on the payment transaction, the artist reserves the right to block the buyer’s order until the problem is resolved.


9. Terms of Delivery
If at the time of delivery the original packaging is damaged, torn, opened, the buyer must then check the condition of the items in the presence of the deliveryman. If they have been damaged, the buyer must imperatively refuse the package and issue written, precise and detailed reservations on the delivery slip.
Such verification shall be deemed to have been carried out when the buyer, or a person authorized by him, has signed the delivery note.


11. Customs Charges
The customs fees are fully insured by the buyer and not included in the Paypal payment. The buyer is responsible for enquiring whether the place of dispatch is subject to customs duties (in general, if delivery outside the European Union).


12. Information on artworks
The artworks governed by these general conditions of sale are those that appear on the artist’s website and that are indicated as sold and shipped by the artist.
The artworks are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred with respect to this presentation, the responsibility of the artist could not be incurred.
Although made with the greatest care, the digital reproductions of the artworks present on the website are not contractual and are only intended for the presentation of original silver prints.


13. Property Attributes
The buyer of the artwork is not invested by his acquisition of any of the attributes of intellectual property. Therefore, no reproduction or distribution of the print is authorized without the prior agreement of the author (Art. L111-3 of the Intellectual French Property Code). However, sharing of content on social networks or other websites for promotional or informational purposes of the author’s artwork is tolerated. For this purpose, a link to https://www.marc-paraskeva-photography.com or failing this, the credit of the images (Marc Paraskeva) must appear.

14. Pricing and Billing
The artist reserves the right to revise the prices of the artworks at any time but agrees to apply the tariffs in force indicated at the time of the order.
Prices are shown in euro for the European Union. They do not take into account the delivery costs, invoiced in addition, and indicated before the validation of the order.
Payment of the entire price must be made at the time of the order. At no time may the sums paid be considered as a deposit or a deposit.
All artworks are delivered with an invoice (VAT not applicable - Art. 293 B of the CGI) and a certificate of authenticity signed by the artist.


15. Means of payment
Payment is made online using a secure Paypal payment system. The artist does not collect your banking data and has chosen a well-known payment system (Paypal) that ensures a sufficient level of security.


16. Claims
The buyer must formulate with the artist (by the link "Contact") any claim in advance to the dispute management service of Paypal and initiate, before any activation of it, an arrangement by direct agreement with the artist. Any return of artwork must be the subject of a formal agreement between the artist and the buyer.

17. Unavoidable circumstances
Any circumstances beyond the control of the parties preventing the performance under normal conditions of their obligations shall be considered as grounds for exemption from the obligations of the parties and shall result in their suspension.
The party relying on the above circumstances must immediately notify the other party of their occurrence and disappearance.
All irresistible facts or circumstances, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which cannot be prevented by the parties, despite all reasonably possible efforts, shall be considered as cases of force majeure. Expressly, are considered as force majeure or accidental cases, in addition to those usually retained by the jurisprudence of the French courts and tribunals: the blocking of means of transport or supplies, earthquakes, pandemic, fires, storms, floods, lightning, the shutdown of telecommunications netartworks or difficulties specific to telecommunications netartworks external to purchasers.
The parties will artwork together to examine the impact of the event and agree on the conditions under which the contract will be continued.
